What if My Blood Alcohol Level Was Above 0.16%?
There are three tiers to the DUI law in Pennsylvania. The third-tier, or Highest Tier carries the stiffest penalties. You might face tier-three charges if you were found to have a blood alcohol level at or greater than 0.16%. The penalties for this level are serious, and they grow more serious if this is your second, third, or subsequent DUI within a ten year window.
If this is your first DUI offense at tier three in the last ten years, you face:
- Minimum of 3 days to a maximum of 6 months in jail
- Additional 12-month license suspension
- $1,000 to $5,000 fine
- Conviction of an M grade offense
If this is your second DUI offense in the last ten years, you face:
- Minimum of 90 days to a maximum of 5 years in jail
- Additional 18-month license suspension
- $1,500 or higher fine
- Conviction of an M1 grade offense
If this is your third DUI offense in the last ten years, you face:
- Minimum of 1 year to a maximum of 7 years in jail
- Additional 18-month license suspension
- $2,500 to $15,000 fine
- Conviction of an F3 grade offense
In addition to those penalties a DUI conviction in the Butler County Courts may require additional obligations including: a Court Reporting Network (CRN) evaluation, a full drug and alcohol evaluation, drug and alcohol treatment, Alcohol Highway Safety School, community service and participation in a Victim Impact Panel sponsored by the Mothers Against Drunk Driving (MADD).
